Terms of Service

Last updated: October 2026

These Terms of Service govern the use of the LocalKurb website (www.localkurb.com), its app and its services. By using LocalKurb, a user accepts these Terms; a person who does not accept them may not use LocalKurb.

01

The Service and Its Fees

LocalKurb operates an online platform on which hosts and independent service providers offer accommodation, services and goods to guests and customers.

Commission and fees:LocalKurb charges hosts and service providers a commission on bookings and orders paid online, and the other fees set out in the Host & Provider Agreement. The amounts that apply to each host or service provider are shown in their account. Sales paid in cash carry no commission.
Closing an account:A user may stop using LocalKurb at any time and ask for the account to be closed through the support desk or by writing to the address given in the Privacy Policy.
02

Payments

Payments on LocalKurb are processed by Stripe, an independent payment service provider.

Stripe:To receive payments, a host or service provider connects a Stripe account to LocalKurb and completes Stripe's verification. Stripe's own terms apply to the use of Stripe.
Refunds:Whether a refund is due is determined by LocalKurb's Cancellation Policy, not by the rules of the individual host or service provider. Refunds are returned to the original payment method through Stripe.
Payouts:LocalKurb deducts its commission and fees from each payment and pays the remaining amount to the host's or service provider's Stripe account, under the conditions shown in their account and in the Host & Provider Agreement.
03

Legal Obligations (Spain)

Hosts and service providers are responsible for complying with the local, regional and national laws that apply to their activity.

Personal data:LocalKurb processes personal data as a data controller, as described in the Privacy Policy. A host or service provider that uses customer data for its own purposes, for example to meet its own legal obligations, does so as a controller in its own right.
Traveller registration (Real Decreto 933/2021):In Spain, the host is responsible for collecting the identity details of its guests and reporting them to the police (Policía Nacional, Guardia Civil or the competent regional police). LocalKurb does not report guests to the police. LocalKurb does send the reports described in the Privacy Policy, such as the report on stays in Spain to the Ministry of Housing and the DAC7 report to the Spanish Tax Agency; these do not replace the host's own obligations.
04

Liability

LocalKurb's liability is limited to the extent permitted by applicable law. Nothing in these Terms limits any liability that cannot be limited by law, or the rights of consumers.

Damage to property:LocalKurb is not responsible for damage, theft or vandalism caused to accommodation by guests, customers, hosts or service providers, except where the law provides otherwise.
Personal injury:Each host and service provider is responsible for the safety of its accommodation and services. LocalKurb is not liable for injury that occurs during a stay or a service, except where the law provides otherwise.
Indemnification:A user who breaches these Terms or the law indemnifies LocalKurb against the claims, losses and costs, including reasonable legal costs, that result from that breach.
